TERMS AND CONDITIONS
The following terms and conditions represent the terms and conditions upon which you agree to participate in this photography retreat.
Fees
The cost of this photography retreat is $4300 (early bird price $4050 expires 18/02/2025).
To secure your ticket, a minimum 25% deposit is required.
The remaining balance is to be paid in 3 equal instalments on the 1st April 2025, 1st June 2025 & 1st August 2025.
Inclusions and exclusions
The retreat cost includes: Scenic return flight transfers from Hervey Bay airport to Lady Elliot Island, 3 nights/4 days accommodation in a private eco cabin with shared bathroom amenities, daily buffet breakfast, lunch and dinner for the duration of the retreat, guided underwater photography sessions, 2x boat trips, and 2x Underwater preset packs. Any other expenses are the sole responsibility of the participant. The participant expressly acknowledges that the retreat cost does not include any airfares to or from Hervey Bay, airport taxes, or items of a personal nature, unless specifically noted in the inclusions list for the retreat content. The retreat cost also excludes any insurance coverage for trip cancellation/interruption, travel accident, travel delay, baggage delay, loss or theft, medical or hospitalisation expenses. We recommend you contact your relevant insurer in relation to the above-mentioned insurance coverage.
Travel
All participants are responsible for making their own way to and from Hervey Bay Airport. We will be meeting at Hervey Bay Airport on Saturday 1st November 2025 at 9:30am (QLD time) so please make arrangements to ensure you do not miss the arranged scenic flight. If you are late you will be responsible for arranging your own flight transfer to Lady Elliot Island and may miss workshop time.
Refund Policy
All ticket sales and payments are final. No exchange, credit or refund will be given in the case of certain cancelled or rescheduled events. For clarification, you are not entitled to a refund if:
you changed your mind
you are no longer able to attend the event
you did not enjoy the event
you arrive late or are refused entry for any reason
A ticket is transferrable to another person under the following conditions:
*A request is submitted in writing and the new attendee meets retreat requirements.*
Cancelled trips
Sea Through The Lens Photography and Jasmine Skye Photography reserves the right to cancel any retreat for any reason whatsoever, including too few participants or logistical problems such as strikes, wars, acts of God, pandemics, or any other circumstances, which may make operation of the retreat inadvisable or unviable, including the safety and security of participants and their equipment. All retreat payments, which were received in relation to a cancelled retreat, will be promptly transferred to another workshop or retreat, or held in credit, and you acknowledge that this is our only obligation to you. We expressly state that we will not be responsible for any costs associated with travel, accommodation, insurance or any other costs other than the workshop cost that may be associated, either directly or indirectly, with the cancellation of a retreat.
Trip Insurance
Sea Through The Lens Photography and Jasmine Skye Photography recommend that all participants have their own medical and travel insurance, which, may, depending on the terms of your insurance, reimburse for non-refundable airfare and trip cancellation fees should the attendee cancel the trip due to personal or family illness. Life insurance, baggage loss and baggage delay reimbursement plus other coverage is also advisable.
Medical
The participant acknowledges that this retreat is an ocean based experience which involves swimming in various depths and conditions in the ocean. The participant confirms that they can confidently swim unassisted, are comfortable in the ocean and does not have any medical conditions that would put their own or other participants safety at risk. Please note - There is no requirement to hold breath for any extended length of time.
Limitation of Liability.
Payment for your booking represents your acceptance of all terms and conditions outlined anywhere within this contract. This contract must be completed for each and every person booking this retreat. Your signature further represents your acceptance of these terms and conditions.
By signing this document you hereby accept that Sea Through The Lens Photography and Jasmine Skye Photography has no liability for any damages, losses, or expenses of whatever cause or nature, including those resulting directly or indirectly from acts of God, detention, annoyance, weather, quarantines, strikes, civil disturbance, theft or criminal activity of any kind, government regulations, etc., over which it has no control.
Sea Through The Lens Photography and Jasmine Skye Photography will take all necessary precautions to ensure the safety of the participant to the best of our ability, however; the participant recognises that the ocean is unpredictable and that Sea Through The Lens Photography and Jasmine Skye Photography cannot be held liable for any incidents that may occur.
The participant acknowledges that the beach and/or ocean is not owned, operated, supervised, managed or controlled by Sea Through The Lens Photography or Jasmine Skye Photography, the participant will enter the ocean at their own risk and confirms they can swim unassisted and are confident in the ocean.
The participant agrees to indemnify, defend, hold harmless and release Sea Through The Lens Photography and Jasmine Skye Photography from all liability to the client or their family for any loss or damage resulting from physical or mental injury, death or property damage arising from their/their families participation in the retreat.
Without limiting the above paragraph, Sea Through The Lens Photography and Jasmine Skye Photography shall have no responsibility for additional expenses due to unforeseen delays caused by weather, theft or criminal activity of any kind, political disputes, acts of terrorism, strikes, sickness, failure of flights or other transportation to arrive or depart on time, and other causes beyond our control. Sea Through The Lens Photography and Jasmine Skye Photography are not responsible for additional hotel nights not specified in the retreat itineraries which may be required en route, prior to or following a trip, caused by airline scheduling or schedule changes, or by individual clients’ travel arrangements or by other factors. Sea Through The Lens Photography and Jasmine Skye Photography cannot assume any responsibility for loss or damage to baggage or personal property.
Sea Through The Lens Photography and Jasmine Skye Photography reserves the right to substitute accommodation, facilities, and to alter the itinerary when deemed necessary or advisable. The right is also reserved to cancel any retreat prior to departure upon the refund of all payments minus fees received, which shall release Sea Through The Lens Photography and Jasmine Skye Photography from further liability. Sea Through The Lens Photography and Jasmine Skye Photography are not responsible for any additional expenses incurred by participants in preparing for the trip (i.e. non-refundable advance-purchase air tickets, equipment, etc.) Sea Through The Lens Photography and Jasmine Skye Photography reserves the right to decline to accept or retain any person or member of any trip should such person’s actions or general deportment impede the operation of the trip or the rights, welfare or enjoyment of other members of the trip, and it is agreed that no refunds will be given in such circumstances.
Sea Through The Lens Photography and Jasmine Skye Photography reserves the right to take photographic, film or video records of any of our retreats, and may use any such records for promotional and/or commercial purposes without the requirement for a signed release from any members captured in film or digital media.
Release and Discharge
The participant agrees to unconditionally release and discharge Sea Through The Lens Photography and Jasmine Skye Photography from all liabilities, claims and causes of action that may arise from any act, omission, default, failure or error occurring wholly or partially during the retreat and including whilst in transit to or from the retreat. The participant acknowledges and agrees that this is in addition to any other release and indemnity provided by me by agreeing to the Terms and Conditions of my participation in the retreat.
Indemnity
The participant agrees to indemnify and keep indemnified, Sea Through The Lens Photography and Jasmine Skye Photography from any liability, claim or cause of action that may be brought against Sea Through The Lens Photography and/or Jasmine Skye Photography as a result of or in connection with any act, omission, default, failure or error on the part of Sea Through The Lens Photography and/or Jasmine Skye Photography (including any negligent act, omission, default, failure or error) occurring wholly or partially during the course of the retreat including transit to or from the workshop.
The Participant hereby waives any right to claim and agrees that Sea Through The Lens Photography and/or Jasmine Skye Photography will not be liable for any loss, damage, personal injury, death, economic loss or consequential loss whether in tort, in contract, under statute or otherwise for any default, failure, negligence or error on the part of Sea Through The Lens Photography and/or Jasmine Skye Photography.
If despite these Terms it is found that Sea Through The Lens Photography and/or Jasmine Skye is liable to compensate the Participant, then such liability is limited to the cost of money paid for retreat.
Cooperation
The participant agrees to full cooperation with Sea Through The Lens Photography and Jasmine Skye Photography during the entire retreat and acknowledges that Sea Through The Lens Photography and/or Jasmine Skye Photography cannot be held liable for any results of poor cooperation on the participants behalf. All participants are expected to behave in a professional manner and adhere to all rules laid out by both Lady Elliot Island Eco Resort and Sea Through The Lens Photography/Jasmine Skye Photography during the entire retreat. Sea Through The Lens Photography and Jasmine Skye Photography reserves the right to refuse entry or require the Participant to leave if their behaviour is deemed unacceptable.
The Participant understands and agrees that the ocean can be heavily impacted by the weather, therefore a degree of flexibility is required for underwater photoshoots. Should Sea Through The Lens Photography and/or Jasmine Skye Photography deem the ocean conditions unsafe they reserve the right to alter the retreat in order for all Participants to get the most value out of the experience.
The participant acknowledges and agrees to provide creative credit for images and/or content created throughout the duration of the retreat. Credit is to be provided by stating your images were captured at The Way of Water retreat and tagging @seathroughthelensphotography and @jasmineskyephotography.
Model Release
The participant hereby assigns and grants Sea Through The Lens Photography and Jasmine Skye Photography the irrevocable and unrestricted right to use and publish photographs of the participant or in which the participant may be included, for editorial, trade, advertising or any other purpose and in any manner and medium; to alter the same without restriction; and to copyright same. The participant hereby releases Sea Through The Lens Photography, Jasmine Skye Photography and their legal representatives and assigns from all claims and liability relating to said photographs. It is agreed that Sea Through The Lens Photography and Jasmie Skye Photography may display and use the photographs taken for advertising, display, website and internet promotion, photographic contests, public display such as in malls, photography books, photography instructional books, store fronts, window displays, studio display, television, advertising, magazine advertising and any other purpose thought proper by Sea Through The Lens Photography and Jasmine Skye Photography.
Performance
The performance of this contract is contingent upon acts of God, weather, flood, fire, warfare, pandemic, government laws or regulations, electrical failure, equipment failure, strikes by suppliers, and/or any conditions beyond its control.
Severability
If any provision of this agreement is held to be invalid or unenforceable under the law, the validity of this agreement as a whole shall not be affected, and all other provisions of the agreement shall remain in full force and effect.
Amendments
This contract has been freely negotiated and shall be recognised as the entirety of the agreement. Only those changes or modifications specifically placed in writing, attached, dated and signed by the Participant and Sea Through The Lens Photography/Jasmine Skye Photography at the time of acceptance of this contract shall be recognised as amendments to this contract.
I have read and understood the terms above. I hereby agree to the terms of this agreement.
